Debt Recovery in Türkiye for Foreign Creditors: Enforcement, Provisional Attachment and Litigation
A foreign creditor with an unpaid invoice against a Turkish counterparty usually wants one answer: “How quickly can we collect?”
The better legal question is: What document proves the debt, what defence is likely, where are the debtor’s assets, and which procedure protects the creditor’s position most effectively?
1. Start with the evidence, not the enforcement office
Before proceedings, the creditor should organise:
- contract;
- purchase order;
- invoice;
- delivery documents;
- account statements;
- correspondence acknowledging the debt;
- payment schedule;
- guarantees;
- negotiable instruments if any;
- notices and default correspondence; and
- information about debtor assets.
A weak file does not become strong merely because proceedings are filed quickly.
2. Enforcement without a prior judgment
Turkish enforcement law provides routes through which a creditor may commence enforcement without first obtaining a court judgment in appropriate cases.
The debtor may have statutory objection rights. If a valid objection is filed, the creditor may need to pursue the appropriate judicial route to overcome the objection before collection can continue.
The strategy should anticipate the objection rather than discover it after filing.
3. Litigation
Where liability is genuinely disputed, a court claim may be the correct route.
The claimant should assess:
- jurisdiction;
- governing law;
- contractual forum clauses;
- mandatory mediation requirements where applicable;
- limitation periods;
- foreign-language documents and translation;
- expert evidence;
- interim measures; and
- enforcement after judgment.
Foreign claimants should also check whether security-for-costs or treaty issues arise in the specific case.
4. Provisional attachment (ihtiyati haciz)
A provisional attachment is a protective measure aimed at preserving assets for qualifying monetary claims when statutory conditions are satisfied.
It should not be confused with a general injunction.
The applicant must establish the legal basis and comply with the court’s order, including any security requirement imposed.
Timing matters because a provisional measure that is not followed by the required procedural steps can lose effect.
5. Provisional attachment vs injunction
The two measures serve different legal functions.
- Provisional attachment primarily protects recovery of a qualifying monetary claim by securing assets.
- An injunction generally protects the subject matter or legal position in other types of disputes.
Choosing the wrong measure can waste both time and leverage.
6. Asset intelligence
Collection strategy should consider the debtor’s actual asset profile:
- bank accounts;
- real estate;
- vehicles;
- receivables from third parties;
- company shares;
- movable assets;
- ongoing business income; and
- assets that may be transferred or encumbered.
A paper judgment without recoverable assets may have limited commercial value.
7. Foreign judgments and arbitral awards
If the creditor already holds a foreign judgment or arbitral award, the Turkish process may involve recognition/enforcement rather than re-litigating the underlying debt.
The route depends on the nature of the decision, applicable treaties and Turkish procedural requirements.
8. Settlement remains part of enforcement strategy
Starting proceedings does not eliminate settlement.
A settlement should address:
- admitted amount;
- payment dates;
- default consequences;
- security;
- acceleration;
- releases;
- costs; and
- enforceability.
An informal promise to “pay next month” can simply reset the delay cycle.
Frequently asked questions
Can a foreign company start enforcement in Türkiye?
Yes, subject to the applicable procedural and documentary requirements.
Do I need a Turkish court judgment first?
Not in every case. Enforcement routes vary by claim and document.
Can assets be frozen before the final judgment?
A provisional attachment may be available for qualifying monetary claims if statutory conditions are met.
Does an invoice alone guarantee collection?
No. The evidentiary value depends on the transaction, objections, delivery/performance evidence and other records.
What is the first practical step?
Preserve documents and identify assets before choosing the procedure.
